These Terms of Service govern your access to and use of the Qjobz website, web platform, mobile applications, APIs, and related services.

1. Acceptance of Terms

By accessing or using Qjobz, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use the platform.

These Terms apply to all users of Qjobz, including business owners, administrators, dispatchers, technicians, employees, contractors, and any person or organization using the platform.

2. Eligibility

You must be at least 18 years old and legally able to enter into a binding agreement to use Qjobz.

If you use Qjobz on behalf of a company or organization, you represent that you have the authority to accept these Terms on behalf of that company or organization.

3. User Accounts

To use certain features of Qjobz, users may be required to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

  • You must provide accurate and current account information.
  • You must not share your login credentials with unauthorized persons.
  • You are responsible for managing user roles and permissions.
  • You must notify us promptly of any unauthorized account access.

4. Subscription Plans

Qjobz may be offered through monthly, annual, trial, promotional, or custom subscription plans. Available features may vary depending on the selected plan.

Subscription plans may include user limits, technician limits, usage limits, feature restrictions, support levels, and other plan-specific terms.

Qjobz may change, update, upgrade, downgrade, or discontinue subscription plans at any time, subject to applicable agreements and notice requirements.

5. Billing & Payments

By subscribing to Qjobz, you agree to pay all applicable fees associated with your selected plan, including subscription fees, usage-based charges, taxes, transaction fees, and any other applicable charges.

  • Subscription fees may be billed in advance.
  • Plans may renew automatically unless cancelled.
  • Failed payments may result in service limitation or suspension.
  • Taxes may be added where required by law.
  • Refunds, if any, are handled according to the applicable billing policy.

Payments may be processed by certified third-party payment processors. Qjobz does not store full card numbers or card security codes on its own servers.

6. Acceptable Use

You agree to use Qjobz only for lawful business purposes and in accordance with these Terms.

You must not:

  • Use Qjobz for fraudulent, illegal, abusive, or harmful activities.
  • Send spam, unauthorized marketing, or unlawful communications.
  • Upload malware, viruses, or harmful code.
  • Attempt to gain unauthorized access to systems, data, or accounts.
  • Reverse engineer, copy, modify, or exploit the platform.
  • Interfere with platform security, availability, or performance.
  • Use Qjobz in a way that violates third-party rights or applicable laws.

7. Communication Services

Qjobz may provide communication features including SMS messages, voice calls, email notifications, push notifications, call routing, call logs, masked numbers, and related communication tools.

You are responsible for ensuring that your use of communication features complies with all applicable laws, including consent, recording, marketing, telecommunications, and privacy laws.

If call recording is enabled, you are responsible for notifying participants and obtaining any required consent before recording calls.

8. Customer Data

Companies using Qjobz may upload, enter, or process customer information, job information, invoices, estimates, addresses, phone numbers, notes, files, photos, and related business records.

As between Qjobz and the company using the platform, the company retains ownership of its customer data. Qjobz processes customer data only as needed to provide, secure, support, and improve the services.

You are responsible for obtaining any required permissions or consents from customers, employees, technicians, and other individuals whose information is entered into Qjobz.

9. User Generated Content

Qjobz may allow users to upload or submit content, including job photos, documents, invoices, estimates, attachments, chat messages, notes, timelines, and other materials.

You retain ownership of your content. By submitting content to Qjobz, you grant Qjobz the right to host, store, process, display, transmit, and use that content as necessary to provide the services.

You must not upload content that is illegal, harmful, misleading, infringing, confidential without authorization, or otherwise violates these Terms.

10. API & Integrations

Qjobz may provide APIs, integrations, webhooks, or connections with external systems and service providers. Your use of such features must comply with these Terms and any applicable technical documentation.

  • You are responsible for securing API keys, tokens, and credentials.
  • You must not overload, abuse, or disrupt APIs or integrations.
  • External services may be subject to their own terms and availability.
  • Qjobz is not responsible for failures caused by third-party systems.

11. Service Availability

We work to keep Qjobz available and reliable. However, the platform may be unavailable from time to time due to maintenance, updates, outages, hosting issues, internet disruptions, third-party service interruptions, security events, or circumstances beyond our control.

Qjobz does not guarantee uninterrupted or error-free service unless expressly stated in a separate written agreement.

12. Data Security

Qjobz uses reasonable administrative, technical, and organizational safeguards designed to protect platform data and user accounts.

You are responsible for using strong passwords, limiting user access, managing permissions, protecting devices, and promptly notifying us of suspected unauthorized access.

13. Intellectual Property

Qjobz, including its software, website, platform, design, branding, logos, workflows, features, documentation, source code, and related materials, is owned by Qjobz or its licensors.

These Terms do not grant you ownership of Qjobz intellectual property. You receive only a limited, non-exclusive, non-transferable right to use the platform according to these Terms and your subscription plan.

14. Suspension & Termination

Qjobz may suspend or terminate access to the platform if:

  • You violate these Terms.
  • Payment fails or remains overdue.
  • Your use creates security, legal, operational, or reputational risk.
  • You misuse communication, payment, API, or platform features.
  • We are required to do so by law or by a service provider requirement.

You may stop using Qjobz or cancel your subscription according to the applicable cancellation process.

15. Limitation of Liability

To the maximum extent permitted by law, Qjobz will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of revenue, loss of data, business interruption, or service downtime.

Qjobz is a business management platform. You remain responsible for your business decisions, customer relationships, technician actions, pricing, billing, legal compliance, and operational outcomes.

16. Governing Law

These Terms are governed by the laws applicable to the legal entity operating Qjobz, without regard to conflict of law principles.

Any disputes related to these Terms or the use of Qjobz will be handled in the appropriate courts or forums as determined by applicable law or any separate written agreement between the parties.

17. Changes to These Terms

Qjobz may update these Terms from time to time. When changes are made, the “Last Updated” date will be revised.

Continued use of Qjobz after changes become effective means that you accept the updated Terms.
